인도네시아 국민의 속마음이 담겨있는 판례들로 구성된 책은 한국 독자에게 처음 소개되는 셈이다. 인도네시아의 대학들과 학생들을 매일 만나는 인연이 10년이 넘어가니 인도네시아의 광대한 천연자원 그리고 아픈 역사와 함께 살고 있는 사람이 숨결로 느껴졌다. 그간 인도네시아 대사, 총장, 교수, 학생들과 법체계에 대해 공유하였던 대화를 가끔씩 논문으로 발표하긴 했지만 더 깊숙한 면은 국내 판례에 나타나거나 나타나지 못한 원고와 피고의 이야기에서 발견할 수 있을 것 같아 역사와 함께 인도네시아 국민들이 마음에 담고 있는 국내 판례들의 이야기를 소개하고자 한다. 국제 판례는 국제기준과 법감정이 실린 재판소의 의견을 객관적으로 제시하였지만 인도네시아 국 민의 법감정은 사실 다르다는 것이 저자들의 생각이다. 인도네시아는 세계인구 4위로 5개의 종교를 공식적으로 인정하고 아직 술탄의 통 치를 인정하는 다양성이 존재하며, 1945년 국가이념으로 빤자실라(Pancasila)를 채택하여 지금에 이르는 동력을 만들었다. 과거 350년 에 가까운 네덜란드의 통치와 독립, 말레이시아 국가형성과정에서의 역사적 전쟁 속 이야기를 판례에서 읽을 수 있다. 또한 주변국의 어 업으로 자국어민이 피해를 입자 불법조업선을 포탄으로 침몰시켜 버린 여성장관의 이야기도 판례에서 찾을 수 있다. 인도네시아 변호사 3인과 함께 만든 이 책은 인도네시아 국민으로서 솔직한 이야기를 담고 있다. 한국 독자들이 인도네시아를 이해하는데 조금이나마 도움 이 되었으면 한다.
