“우리는 누구나 어떤 이유에서든 소수자다!” 대한민국 국회에서 세 차례에 걸쳐 발의된 차별금지법안은 보수주의 기독교계의 격렬한 반대 운동에 따라 현재 여전히 국회 법사위원회에 계류중이다. 보수주의 기독교계에서 반대하는 가장 큰 이유는 법안에 ‘성적 지향’이란 대목이 포함됐기 때문이다. 차별금지법안이 통과되면 목회자가 동성애를 비판하거나 동성애자들의 교회 사용을 거부했을 경우 법적 제재를 당할 수 있다. 법이 도덕적 논쟁에서 발을 빼는 것은 과연 옳은 방식인가? 이에 대해 저자 마사 C. 누스바움은 법률 및 사회가 동성애를 대할 때에 갖는 ‘혐오’라는 감정이 어디에서 유래했는지, 그리고 그와 같은 혐오가 동성애자들의 권리를 제한하는 근거로 정당한 것인지에 대한 고민으로부터 시작한다. 이처럼 이 책은 헌법과 법률에 관한 책이기도 하지만, 우리 사회가 성소수자를 대할 때 갖는 ‘혐오’라는 감정에 대한 훌륭한 사회과학적 분석서로서의 역할도 하고 있다. 우리나라에서는 동성혼에 관한 논의가 이제 막 시작되고 있다. 영화감독 김조광수와 그의 파트너 김승환은 2014년 5월 21일 서울특별시 서대문구청의 혼인신고 불수리 처분에 대해 불복하는 소를 제기하였다. 그전에도 동성 간에 혼인 신고를 하려는 시도는 있었으나 여론의 관심을 끈 적은 없었고, 당연히 동성혼을 인정할 것인지 여부에 관하여 정면으로 판단한 대법원 판결이나 헌법재판소 결정도 없다. 이런 점에서 이 책은 미국 연방대법원의 2015년 6월 26일 동성결혼 합헌이라는 획기적인 판결이 있기까지의 역사와 평등권에 관하여 새로이 개척해나가고 있는 법리를 이해하는 데에도 탁월한 책이다. A distinguished professor of law and philosophy at the University of Chicago, a prolific writer and award-winning thinker, Martha Nussbaum stands as one of our foremost authorities on law, justice, freedom, morality, and emotion. In From Disgust to Humanity, Nussbaum aims her considerable intellectual firepower at the bulwark of opposition to gay equality: the politics of disgust. Nussbaum argues that disgust has long been among the fundamental motivations of those who are fighting for legal discrimination against lesbian and gay citizens. When confronted with same-sex acts and relationships, she writes, they experience "a deep aversion akin to that inspired by bodily wastes, slimy insects, and spoiled food--and then cite that very reaction to justify a range of legal restrictions, from sodomy laws to bans on same-sex marriage." Leon Kass, former head of President Bush's President's Council on Bioethics, even argues that this repugnance has an inherent "wisdom," steering us away from destructive choices. Nussbaum believes that the politics of disgust must be confronted directly, for it contradicts the basic principle of the equality of all citizens under the law. "It says that the mere fact that you happen to make me want to vomit is reason enough for me to treat you as a social pariah, denying you some of your most basic entitlements as a citizen."
